Cappsure, Inc. (“Cappsure” “we” or “us”) respects your privacy and we have created this Privacy Policy to help explain to our visitors of the Site and users of the Services (“you”) how we or our service providers collect and use information about you. Please read this Privacy Policy carefully to understand how your information is treated.

By accessing and using the Services, you represent and warrant that you have read and understood, and that you agree to be bound by, this Privacy Policy. If you disagree with any part of this Privacy Policy, you do not have permission to and so should not access or use the Services.

Please note your use of the Services is also subject to our Terms of Service.

What Information Does Cappsure Collect?

 

(1) Personal Information:

Personal Information is defined as any information that is sufficient to, alone or in combination with other Personal Information, specifically identify or contact you (e.g., your name, email or physical address, phone number, etc.).

Cappsure collects Personal Information that you provide to us when you interact with us for service, support and payment, including contact information (full name, address, telephone number, and email address), your user ID and password that allow you to access the Services, demographic data (age, income, and zip code) and any feedback, emails, search inquiries, communications and other interactions with our Services that personally identify you.

To the extent your financial data is not collected to create an account, it may be collected through a third party payment processor in order to finalize and complete a transaction. Any collection or use of your financial data or other Personal Information by a third party payment processor is subject to that payment processor’s terms of use and privacy policy.

(2) Non-Personal Information:

Non-Personal Information is information that does not personally identify you. The servers hosting the Services, like most servers, gather Non-Personal Information of the sort that browsers routinely make available, such as your IP address, domain server, browser type, operating system, date/time, referring and exit pages, and “click stream” data relating to your navigation of the Site and your use of the Services. The servers hosting the Services also gather data made available by your mobile device, including your mobile carrier, phone number and location (including geolocation, beacon based location and GPS location).

How Does Cappsure Use the Information Collected?

 

(1) Personal Information

Cappsure uses your Personal Information to help us provide you with the Services; to help you complete a transaction or to deliver information requested by you; to connect you with merchants, vendors or other third-parties whom you have expressed an interest in communicating with; to bill you for Services you purchased; to enforce our Terms of Service including investigation of potential violations; to meet any applicable law, regulation, subpoena, legal process or enforceable governmental request; to notify you about issues with or changes to the Services, our Terms of Service or this Privacy Policy; to improve our Site, Applications, and Services which includes developing data analytics and reports about your use of them; to deliver tailored advertisements which may interest you; to email you with marketing or promotional information about Cappsure or others’ products or services that may interest you; or for any other purpose with your consent.

Cappsure uses third-party vendors to provide various services, including data storage and processing, fraud detection, and data analysis. We provide those vendors with your Personal Information, though only as absolutely necessary for them to perform those services. We require our vendors to contractually agree to treat your information in accordance with the Privacy Policy in effect at the time we collected that information. All the vendors to whom we provide data are located in the United States.

Cappsure may, from time to time, obtain your permission to share your Personal Information. For example, we may ask you if you would like one of our partners to contact you with special promotions or deals, or if you could provide us with a testimonial and are willing to be quoted. Cappsure understands that it is important to always obtain your permission first, before sharing this type of information.

(2) Non-Personal Information

Cappsure uses your Non-Personal Information to better understand how you and others are using the Services, and to help us detect security threats and potential fraud. As part of our effort to better understand Services usage, we employ Google Analytics, a service that helps us analyze Non-Personal Information. By better understanding how the Services are used, we are able to refine and expand popular features, increase technical capacity in advance of bottlenecks, and generally improve the Services’ usability, stability and security. We do not attempt to match Non-Personal Information with Personal Information, or to otherwise individually profile you based on your use of the Services.

Cappsure discloses Non-Personal Information in aggregate form to consultants hired to help Cappsure improve the Services and to accomplish the goals set out in the prior paragraph. We also disclose Non-Personal Information in occasional reports summarizing usage of the Services.

Transfer in the Event of Sale or Change of Control

In the event that Cappsure undergoes a sale, merger, reorganization, or other change of control, the Personal Information and Non-Personal Information we have collected from you will be transferred to and used by this acquiring entity. Furthermore, in the event a bankruptcy or reorganization proceeding is brought against us, all such information may be considered an asset of Cappsure and as such may be sold or transferred to third parties. Any acquirer of your Personal Information and Non-Personal Information would be obligated to treat that information it in accordance with the version of this Privacy Policy in effect when that information was collected. Cappsure will not be liable for the use of disclosure of information no longer in its possession.

Cookies

Cappsure may use cookies in connection with the collection of information about your use of the Services. “Cookies” are simple text files from a website that are stored on your hard drive. Cookies make using the Services more convenient by, among other things, allowing you to save password and preferences. Cookies do not usually contain any information that could personally identify you.

We use Cookies and similar technologies to identify you as a previous user of the Services, and to save certain of your Website preferences. We also use Cookies for “session management” purposes, meaning to help the Services remember where you are, where you’ve been, and what you’re in the process of doing. Additionally, we use Cookies to monitor the usage of the Services, to understand how our users get to us, and to gather other statistical data that we use for purposes of improving your and others’ user experiences.

Location Information

When you use the Services, Cappsure may collect your geographic location by using various technologies including GPS coordinates sent by your mobile device unless you configure your operating system settings to prevent the collection of location information.

Users in California

Residents of the State of California, under California Civil Code Section 1798.83, have the right to request information regarding the disclosure of your personal information by Cappsure to its affiliates and/or third parties for their direct marketing purposes. You are limited to one request per calendar year.

To make such a request, please send an email to legal@cappsure.com attesting to the fact that you are a California resident and include your full name, telephone number, email address and current California mailing address for our response. Please include “California Privacy Rights” in the subject line of your email.

Children

Cappsure understands and is committed to protecting children’s privacy online. Our Services are not designed for and do not intentionally target or solicit anyone under 13 years of age. If Cappsure learns or has reason to suspect one of our Users is under the age of 13, we will promptly delete any Personal Information in that User’s Account.

Security of Your Information

Cappsure has implemented reasonable security measures, including firewalls and SSL encryption, designed to protect your personal information from accidental loss and from unauthorized access, disclosure, use, alteration, or destruction. Please be advised that while we strive to protect your Personal Information, we make no guarantees or assurances about our ability to prevent any such loss or misuse and we are not responsible in the event that such loss or misuse occurs.

You are responsible for maintaining the security of your login information.

We Don’t Track You

Other than for purpose of analyzing Non-Personal Information in aggregate form, we do not permit third parties to collect information about you or your or others’ use of the Services.

Third Party Sites

Please be aware that this Privacy Policy applies only to information Cappsure collects through use of our Services. Our Site or Applications may contain links to third party payment processors and other third party sites that we do not own, control, or maintain. Cappsure is not responsible for the privacy practices of such other sites. We encourage you to read the privacy policies of each and every third party site that you visit and interact with before submitting any personally identifiable information.

Corrections, Deletions and Account Terminations

You can review your Personal Information at any time by means of the Site. Please note that deletion of certain of your Personal Information could result in the termination of your Account.

Changes to Our Privacy Policy

We may update this Privacy Policy from time to time. We will notify you of any updates by posting a notice on the Site or by email sent to your most recently provided email address. By continuing to use the Services after receiving notice of an update, you agree to be bound by the updated Privacy Policy. Our use and disclosure of particular information will be governed by the Privacy Policy in effect at the time we gather that information.
